An owner may consider carrying part or all of the purchase price when a buyer cannot or does not want to obtain conventional mortgage financing. This is not simply a cash offer with a later payment date. The structure may involve a promissory note, deed of trust, interest terms, payment schedule, balloon provisions and lien position. Ask a California real estate attorney and suitably qualified mortgage or settlement professional about consumer-finance restrictions, licensing, disclosure obligations and any exemptions that may or may not apply. Do not copy an internet sample note into a contract and assume it is enforceable. If the seller has an existing mortgage, have counsel investigate due-on-sale and payoff provisions rather than assuming the balance can remain unchanged.

Evaluate credit, collateral and servicing risks

A seller considering a carryback needs to understand the buyer's ability to perform, the security interest, priority against other liens and how missed payments would be handled. Review underwriting or verification requirements through qualified advisors and establish what third-party loan servicing and recordkeeping may be appropriate. Ask how taxes, insurance, repairs and HOA obligations will be monitored and which remedies the documents actually authorize. A higher contract interest rate is not automatically a better investment if repayment risk or compliance exposure is significant. Do not advertise guaranteed returns, instant foreclosure rights or a no-documentation loan. A buyer's down payment and property valuation still need to be assessed alongside title and other transactional risks.

Compare net sale alternatives before marketing terms

Prepare a written comparison of a conventional financed sale, a cash offer and a proposed seller-financed transaction, separately showing closing proceeds, retained principal, expected payment terms, taxes and legal or servicing costs. The seller may have different liquidity needs or risk tolerance than another homeowner. Qualified tax advice is necessary before assuming how installment-sale reporting applies. A listing may note that financing terms could be considered, but any actual offer must be evaluated on documented terms and under current law. Have escrow, title and counsel confirm what is recorded and disbursed at closing. The purpose of a careful guide is to help the seller ask the right questions, not to promise a financing workaround for an unqualified buyer.

Common Questions

Can any San Diego seller offer financing without legal review?

No general exemption should be assumed. Consumer-finance, broker, title and tax considerations depend on the particular arrangement.

Does seller financing mean the buyer can skip all financial verification?

That is not a safe assumption. Credit and regulatory obligations require transaction-specific advice.

Can an existing mortgage remain untouched after seller financing?

Do not presume so; request review of lien terms, due-on-sale provisions and the proposed closing structure.

Is seller carryback guaranteed to create higher net proceeds?

No. Payment performance, taxes, legal costs and timing can change the actual outcome.
