Selling San Diego County Land With a Conservation Easement

A rural parcel can have restrictions that remain after sale. An acreage figure alone says little about what can legally be developed.

A rural seller may own acreage with a recorded conservation easement, open-space restriction or deed limitation that affects allowed uses. Obtain the parcel's legal description, preliminary title report, recorded instruments and any maps attached to the restriction. Determine whether a conservation organization or public agency holds enforcement rights and whether monitoring or approval duties apply. Do not assume the land can be subdivided, graded or built upon because a neighboring parcel contains a house. Ask qualified counsel and the applicable land-use authority to interpret the actual restrictions. Some documents protect habitat, agriculture or views in different ways, and the recorded instrument controls the questions to be examined. An MLS aerial outline is not a survey of restricted land.

Separate permitted uses from infrastructure feasibility

Even where residential construction may be discussed, investigate current zoning, legal access, water service, wells, septic feasibility, power connections and fire access independently. The conservation document may restrict new roads, vegetation removal, grading, fencing or building locations. Compare any offered development potential against the exact legal terms and current agency requirements. Ask about maintenance or reporting obligations that could pass with title. A buyer interested in agriculture, horses or a second residence should receive the relevant records and seek project-specific agency guidance; the seller should not make an unconditional promise of those uses. Roads, utility poles and cleared ground visible in photos cannot establish transferable rights or a buildable pad.

Market usable property facts with appropriate limits

Price land using relevant transactions that reflect acreage, legal access, permitted improvements, location and the actual recorded restrictions. A large restricted parcel should not be described as equivalent to unrestricted developable land solely because their lot sizes match. Prepare a disclosure packet with easement documents, available surveys, title records, water information, any governmental notices and inspections of existing structures. Be clear about the current authorized use and any unresolved interpretation questions. Ask the listing broker, title company and qualified advisors to coordinate how restrictions are disclosed and carried forward at closing. A well-supported land description can help buyers evaluate the property without inventing future subdivision, agricultural income or construction outcomes.

Common Questions

Does a conservation easement disappear when the land is sold?

Do not assume so. Recorded restrictions may bind future owners; examine the actual instrument and legal advice.

Does acreage alone show how many homes can be built?

No. Easements, zoning, access, utilities and development approvals require separate parcel-specific review.

Can a listing photo prove a legal building pad exists?

No. Permits, recorded documents and technical feasibility are needed.

Should buyers receive the easement documents before closing?

The relevant recorded restrictions should be reviewed with title and qualified advisors as part of due diligence.
