Selling a Poway Home With a Recorded Utility Easement

A Poway residential parcel may contain an electric, water, storm-drain or sewer easement. Obtain the preliminary title report, recorded grant, relevant subdivision map and any available surveys. Identify the easement's width, stated purpose, location and holder of the rights. Do not describe an easement merely as 'extra setback' or promise that it can be removed whenever the buyer wishes. Some lines are visible; others are buried or no longer obvious from the landscape. A fence, raised planter or shed on the strip does not prove the improvement is permitted under the instrument. If a seller is unsure about the boundaries, ask a qualified surveyor or title professional instead of drawing them from an MLS aerial photo.

Clarify access, maintenance and planned improvements

Review who may enter the easement area, under what conditions, and which party is responsible for maintaining infrastructure or restoring disturbed landscaping. A recorded document may limit building placement, grading or tree planting over a line. That does not automatically mean the entire lot is unusable. If a buyer asks about adding a pool, ADU, retaining wall or new fence, direct the question to the utility holder and planning authority for the particular parcel. Existing structures near the easement require independent permit and title review. Avoid unsupported assurances that an agent, inspector or lender has cleared future construction rights just because the property has a spacious yard.

Make the easement understandable during marketing and escrow

Organize the recorded instruments and any available mapping for prospective buyers through the appropriate title process. Compare sold homes with similar usable lots, access and condition when discussing price; a generic lot-size adjustment does not quantify the impact of this particular easement. Coordinate property disclosures and buyer inspection questions with title, an appropriate surveyor and qualified counsel if the rights are disputed. Include any known utility work notices or repair obligations where relevant. The final sale documents should accurately describe the parcel and exceptions to title coverage rather than relying on informal statements about property lines. A documented easement can often be understood and evaluated, but it should never be hidden or guessed away.

Common Questions

Does a utility easement mean the utility company owns part of my yard?

Not necessarily. Examine the recorded easement and title to distinguish use rights from land ownership.

Can a buyer build an ADU across an easement?

No conclusion is possible without the recorded rights and specific permitting and utility review.

Will an MLS lot-size figure show the easement location?

No. Lot area and precise recorded access or utility rights are different records.

Does a fence establish the true easement boundary?

No. Recorded documents and surveys are better evidence than a visible fence line.
